The Regulatory Reform (Fire Safety) Order 2005 came into force on 1st October 2006 and replaced many existing pieces of legislation, including the Fire Precautions Act 1971 and the Fire Precautions (Workplace) Regulations 1997. The Order imposes the responsibilities of providing and maintaining the fire safety precautions of a property on a single person so that other people can work in safety, or escape safely in the event of a fire.

The Order applies to all premises in the UK and nearly every type of building. Failure to comply with the requirements of the Regulatory Reform (Fire Safety) Order 2005 can lead to a fine or imprisonment.
Where the Order applies to your premises, you must carry out a fire risk assessment and in most cases record it. The recorded assessment should be kept available for inspection by the Fire Authority. The body has formal powers that can be used in serious cases, including the ability to prohibit, with immediate effect, the use of all or part of your premises. It also has the power to serve an ‘Enforcement Notice’, which requires you to take steps to comply with the order. However, if your property is not well-equipped to address a fire emergency, it may place your people at risks of serious or even fatal injuries in the event of a fire. This is a criminal offence, and the Fire Authority, in such cases, may prosecute you for not complying with the legislation.
